Fuji music icon Wasiu Ayinde Marshal, popularly known as K1 De Ultimate (KWAM1), has withdrawn the lawsuit he filed at the Ogun State High Court in Ijebu-Ode seeking to halt the installation process of the next Awujale of Ijebuland.
The withdrawal was effected through a Notice of Discontinuance dated December 22, 2025, and filed before the court following a letter from the Chairman of the Ijebu-Ode Local Government Area, which the claimant said had since been withdrawn.
In the notice, Ayinde asked the court to formally record the discontinuance of the suit and make any consequential orders it considered appropriate.
The development comes a day after Justice A. A. Omoniyi of Court 3, Ijebu-Ode Judicial Division, refused to grant an ex parte application brought by the musician seeking an interim injunction to stop the Awujale installation process.
In his ruling, the judge held that the court could not grant an interim order in the absence of a substantive motion on notice, relying on established precedents including Seven Up v. Abiola and City Express v. LASG. He also cited Order 39 Rule 2 of the Ogun State High Court (Civil Procedure) Rules, which prohibits the granting of an ex parte injunction without a corresponding motion on notice.
Justice Omoniyi further noted that the application was defective because it lacked an undertaking as to damages, which he described as a fundamental requirement in applications for interim injunctions. He consequently dismissed the application.
The Notice of Discontinuance, signed by Dr Wahab Shittu (SAN) on behalf of the claimant, stated that the suit was filed based on a correspondence dated December 2, 2025, from the second respondent, which has now been withdrawn. The document urged the court to record the discontinuance and issue any orders it deemed fit.
