Court stops Police enforcement of tinted glass permit policy

A Delta State High Court has issued an interim injunction restraining the Nigeria Police Force (NPF) from enforcing the tinted glass permit policy across the country.

The ex parte order was granted on Wednesday by Justice Joe Egwu, pending the hearing and determination of a substantive suit challenging the policy.

The case was instituted by Israel Joe, who sued the Inspector-General of Police, the Nigeria Police Force, and the Commissioner of Police, Delta State, as first, second and third defendants respectively.

In his application, the claimant asked the court to bar the police and their officers from stopping, harassing, arresting, detaining or extorting motorists, or otherwise infringing on their constitutional rights to dignity, privacy, freedom of movement and property ownership under the guise of enforcing the tinted glass permit policy.

He also sought an order restraining the police from continuing to use the Parkway Projects account, described as a private contractor’s account, for conducting government-related transactions, pending the outcome of the suit.

After hearing arguments from the applicant’s counsel, Kunle Edun, Justice Egwu granted all the reliefs sought in the ex parte application. The court subsequently fixed December 24 for the hearing of the motion on notice.

The ruling comes amid controversy surrounding the police announcement that enforcement of the tinted glass permit policy would resume on January 2, 2026, citing rising cases of vehicle-related crimes.

In reaction, the Nigerian Bar Association (NBA) accused the police of disregarding an existing court order, describing the move as “executive recklessness” and a display of disregard for the rule of law and due process.

The police, however, rejected the NBA’s position, insisting that no court order has declared the policy unlawful or permanently barred the force from carrying out its statutory duties.
